My EX/ dead beat dad has a Fel/2nd degree/would like to file criminal Suppt.?
WHO COULD I CALL FOR HELP OR SOMEONE THAT DEALS WITH PRO-BONO?????
Found out that my EX/Dead beat dad has been charged with AGG/Assault with a deadlly weapon, 2nd degree felony. Not yet filed, Also CPS has been involved due to the family violance. These kids have been placed with a family member whom has custody and the other is in foster care in Abilene, TX- and their is another one on the way. It doesn't seem that he has any other charges, but a good chance that he will get a lenghty probation. I am wondering if I can file criminal Support & possibly have him served when his trial does about? or relinquish him of his parental rights to my child. My child has made mention to me that he would like to go to the hearing and basically close that chapter of his life. As I am wanting to kick him when he is down!!!! Please remember that his father has not had anything to do with him for over 11 years now, and my child is 16... Any suggestions would be helpful!!!
Contact your local Family court, not the child support office... you can ask them for the information and the proper paperwork you need to petition the court for termination of parental rights, your child is old enough to also be present at the termination hearing and state his wishes to the judge. Unfortunately, you cannot criminally prosecute the dead beat dad, but you may be able to sue, however, you may end up spending money, for money you may never see. If your Ex is found guilty for his current charge, you may be able use his violent tendencies as an example of his demeanor, during the termination hearing. You can file the termination petition on your own, although, an attorney is always recommended, and their is a filing fee. However, ask the clerk at the court if there is a fee waiver affidavit form for the petition you are attempting to file. Good luck to you.... a little advice, don't seek revenge... you already have it... look what you have experienced with your child in the last 16 yrs, and what your ex has missed out on. You should bask in your glory!
