Can anybody manufacture a Memory Stick Pro Duo legally?

Let's say I want to make:
Bob's High-Speed Memory Stick Pro Duo
I make my own chip and put blank black casing with no text on it.
Am I violating copyright laws? Can only Sony and SanDisk legally produce them? Do you need approval or a license or something?
With SD cards, there are a million brands. With Pro Duos, I only see Sony and SanDisk.

see the little me on the top, that is a sony symbol and it certifies it works with all memory stick reader/writers. But as an answer to your question yes, you would need approval to make it because it is probably under some sort of license or patent.
